Terms of Service
These terms cover what you can do with factonisam, what we promise (very little), and what happens if a calculator gets something wrong. Using the site means you accept them.
1. Acceptance
By accessing factonisam.com you agree to these Terms of Service. If you do not agree with any part of them, please stop using the site. These terms apply to every visitor, whether you use one calculator or all hundred, and whether or not you ever contact us.
2. Licence to use the site
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the calculators and read the content for your own purposes, personal or commercial. You may use a result to quote a job, price a product, plan a build or check a figure. You may print a result sheet and share a calculation link. You do not need our permission for any of that.
This licence does not transfer ownership of anything. It ends automatically if you breach these terms, and it does not extend to redistributing the site, reselling access to it, or building a competing service out of its content. You may not remove or obscure any notice, label or attribution, including the "Advertisement" labels required by our advertising partners.
3. Acceptable use
You agree not to: copy substantial portions of the written content and republish it as your own; scrape the site at a rate that degrades it for other people; attempt to gain unauthorised access to any part of the infrastructure; introduce malicious code; frame the site in a way that misrepresents its origin; or use it for anything unlawful. Automated access for search-engine indexing is welcome and governed by our robots.txt.
4. Intellectual property
The written content, page designs, code, logo and name are owned by factonisam and protected by copyright and trade mark law. Mathematical formulas themselves are not ours and cannot be owned by anyone — BMI, compound interest and the annuity formula belong to everybody. Our explanations, worked examples, layouts and implementations are, however, original work. Quote a sentence or two with attribution and a link; do not republish a page.
5. Availability
We aim to keep the site available at all times but make no commitment to any level of uptime. The site may be unavailable during maintenance, during a failure at our hosting provider, or without notice for any other reason. Calculators are cached by your browser after a first visit, so in many cases they continue to work while the network does not — but we do not guarantee that either.
6. Feedback and submissions
If you send us a correction, a calculator request, a formula or any other suggestion, you grant us a perpetual, worldwide, royalty-free licence to use it in operating and improving the site, with no obligation of confidentiality or compensation. Please do not send us anything you consider confidential or proprietary. We will happily credit a substantive correction if you ask us to.
7. No warranty
The site and everything on it is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted, that it will be error-free, or that any result will suit your particular circumstances. Every calculator publishes its formula precisely so that you can check it before you rely on it.
8. Limitation of liability
To the fullest extent permitted by law, factonisam and the people who run it are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the site or your reliance on any result it produces. Where liability cannot lawfully be excluded, it is limited to the amount you paid to use the site, which is zero. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
9. Not professional advice
Nothing on factonisam is financial, investment, tax, legal, medical or engineering advice, and no relationship of adviser and client is created by using it. Our disclaimer covers this in detail and forms part of these terms.
10. Third-party links and advertising
The site links to external pages and carries advertising served by Google. We do not control third-party sites and are not responsible for their content, accuracy, or privacy practices. A link is not an endorsement. Advertising is labelled as such and never influences a calculator's output.
11. Indemnity
You agree to indemnify and hold harmless factonisam and its operators from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the site, or your violation of any law or the rights of a third party.
12. Termination
We may restrict or withdraw access to the site, in whole or in part, at any time and without notice — for example to block abusive automated traffic. You may stop using the site at any time. Sections 4, 6, 7, 8, 9 and 11 survive termination.
13. Governing law
These terms are governed by the laws of [Your country / state — replace before launch], and the courts of that jurisdiction have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you where you live.
14. Changes to these terms
We may revise these terms. The review date at the top of the page shows when they last changed, and continued use after a change means you accept the revised version. Material changes will be summarised at the top of this section for a reasonable period after they are made.
15. Severability and entire agreement
If any provision is found unenforceable, the rest remains in force. These terms, together with the privacy policy, cookie policy and disclaimer, are the entire agreement between you and factonisam regarding the site.
